【Course Objectives】

An accurate understanding of judicial precedents is essential for studying law. Every textbook addresses judicial precedents in some way, and the same holds true for constitutional law. However, it is sometimes difficult to reach a sufficient understanding of judicial precedents with just the summarized contents. In some cases, it is desirable to directly refer to the original text in the official reports. Furthermore, referencing the original text makes the study of judicial precedents enjoyable (according to the instructor’s viewpoint at least ten times more). Because the original text allows for various approaches, there are many ways to enjoy reading judicial precedents. The objective of this seminar is to try out various ways of enjoying the study of judicial precedents.

【Course Contents】

The classes will be conducted in separate units with the spring semester covering individual cases and the fall semester focusing on summaries of multiple judicial precedents (for example, judicial precedents about equality). Due to the different way in which the units are taken, it is expected that classes will focus on individual reports in the spring and group reports in the fall. The judicial precedents which are covered will be selected according to the interests of the participants. Nonetheless, because the seminar concept is the multilateral examination of judicial precedents, for some sessions multiple possible options which can be a focus of discussion will be confirmed using the judicial precedent designated by the instructor as material. (However, participants will still be assigned judicial precedents to cover at this time as well.) Throughout the entire seminar, students in charge of a particular topic as well as the other participants are required to sufficiently prepare and actively participate in the discussions. Students are also encouraged to hold a preliminary seminar to prepare.
