【Course Objectives】

This seminar aims to recognize the criminal law that intervenes and regulates the various expressions in our daily lives, and to learn which problems are appropriate to be solved by punishment or criminal sanctions (and why it is necessary to use punishment to solve them).

【Course Contents】

The freedom of expression is deeply guaranteed under the Constitution due to its importance, and criminal sanctions on the content of expression, in particular, are considered to be extremely restrained and limited. However, there are various forms of criminal restrictions on expressions that infringe on copyright or honor, and the appropriateness and limits of such restrictions are a major issue. With regard to copyright law, important issues to consider are when infringement of copyrights can and should be punished, and whether the punishment should be overly broad.
In addition, with regard to honor, the coordination of freedom of expression and protection of honor has been an issue in relation to Article 230-2 of the Penal Code, and recently, the regulation of online infringing expressions has become a major issue. In addition, the criminal regulation of online infringements that violate people's private tranquility or human emotions has become an important issue.
In this seminar, we plan to deal with the question of criminal regulation of such expressive acts and discuss its problems as well as the ideal legislative theory for the future.
