【Course Objectives】

The objectives of this course are to cultivate the students’ knowledge about Civil Law, the ability to think in a legal manner, and the ability to give presentations through debates about Civil Law.

【Course Contents】

Judicial precedents are often explained in lectures with large numbers of students, but in many cases if you read the actual judicial precedent, you will become aware of case backgrounds which are completely different from what was described in the lecture. In order to study actual cases which cannot be sufficiently learned in large-scale lectures on a deeper level, this seminar will primarily cover the judicial precedents listed in the Top One Hundred and 30 Judicial Precedents! series and separate students into the roles of plaintiff and defendant for debate. Teams will be formed together with upper-class students, so students are welcome to participate starting from the second year.
The seminar will be conducted in a manner which will enable students to deepen their knowledge of Civil Law in a phased manner by passing out preparatory summaries in advance, staging study sessions run by the upper-class students beforehand, holding the debates, and holding a review session the following week to deepen the students’ knowledge. The focus will be on arguments about Property Law, but in addition to acquiring fundamental knowledge about Civil Law, the objectives over this seminar are to cultivate flexible thinking, the ability to demonstrate theories in a persuasive manner, and the ability to understand another person's remarks and judge them in a logical manner.
In addition to the debates, this seminar will also include extracurricular activities such as seminar trips, visits to law offices and companies, and discussions with other universities. Optional interviews will be held for students who wish to participate in the seminar, so please set up an appointment by email. Throughout the year, students will study the entire property law portion of the Civil Code.
