Compared to other legal fields, administrative law tends to develop abstract theories in the lecture. In this seminar, we will study the applocation of administrative law to specific cases using recent Supreme Court precedents, with the aim of understanding the nature of administrative law as it applies to the real world.
I will assign recent Supreme Court cases of interest to each student and ask them to report on them. We will then discuss the cases, and the presenters will report the study results of the unresolved issues in the next week`s session. Therefore, the same student will be in charge of reporting for two consecutive weeks.

行政法は他の法分野と比べ、授業では抽象的な理論が展開される傾向が強いが、本演習では近時の最高裁判例を素材として、具体的な事案に対する行政法の適用を学び、以て現実社会に妥当する行政法の在り方を理解することを目標とする。

注目される近時の最高裁判例を受講者に割り当て、報告してもらう。その上で議論を行ない、解決できなかった論点につき、報告者が次週の回でその検討結果を報告する。従って報告は連続する2週で同一の受講者が担当することになる。

報告担当者は、割り当てられた報告を、文献などに当たった上で準備すること。ここでいう文献は担当判例に関する全ての判例評釈が含まれるが、それにとどまらず、関係する内容を論ずる文献・論文を渉猟すること。
文献調査につき分からない点が生じた場合には適宜相談に応じる。
