The goal is to gain a comprehensive understanding of both the norm and the reality of the right to life, which is the core of the social rights stipulated by Article 25 of the Constitution, by analyzing it from multiple perspectives such as the actual situation, judicial precedents, and history etc.
In Japan, various measures such as public assistance are implemented in order to guarantee the "healthy and cultured minimum standard of life" stipulated in Article 25 of the Constitution. However, in recent years this standard of living has been devalued. Using the text, we will examine what constitutes a healthy and cultured life based on fact-finding surveys, recent court rulings, and history. In the lecture, I would like to proceed based on the discussion of the students.

憲法25条によって規定された社会権の中核を担う生存権について実態や判例、歴史など多角的な視点から分析をすることで規範と実態の両面から総合的な理解ができることを目標とする。

日本では憲法25条で規定されている「健康で文化的な最低限度の生活」を保障するために生活保護などの諸施策が実施されている。しかし、近年この生活基準が切り下げられてきている。テキストを用いながら、健康で文化的な生活とは何かを実態調査や近年の裁判の判決例、歴史などを踏まえて検討する。講義では学生のディスカッションも踏まえて進めていきたい。
