In order to acquire fundamental knowledge concerning foreign law which is required for the study of law in general. Students in this course will study the methods of comparative law, areas adjacent to comparative law, the doctrine of legal families, law and globalization, and other topics.
This course will use the textbook written by myself. The lectures will focus on the basic theories of comparative law. As the second part of this lecture, I will analyze the study of comparative legal history by Prof. Mathias Reimann and the comparative law method by Prof. Giuseppe Monateri.

法学の学習に必要な外国法についての基礎知識を修得するために、比較法の方法、比較法の隣接諸分野、法族論、法とグローバリゼーションなどのテーマを学習する。特にグローバリゼーションが比較法に及ぼす影響に注目する。不十分ではあるが、法学入門としての役割も果たしたい。

担当者が執筆したテキストブックを用い、その内容について詳しく講述する。比較法の基礎理論すなわち比較法原論が講義の中心となる。講義の後半は、比較法各論として、アメリカ比較法学を代表するマティアス・ライマンの比較法史研究とともにイタリアの代表的比較法学者であるジュゼッペ・モナテリの比較法方法論を取り上げる。
