The aim of this course is for students to acquire more specialized knowledge about Conflict of Laws and international codes of civil procedure.
Two companies from different countries conclude an international transaction, and a dispute occurs as a result. Under the existing international civil litigation scheme that uses a national court to resolve disputes, first, a dispute will occur regarding which country's court should resolve the corresponding dispute, and in many cases an efficient dispute resolution is uncertain. Now what if we were to resolve the dispute without using the court of either country or even resolve the dispute without using a national court in the first place? The dispute resolution process that was born from that concept is called "international commercial arbitration." It has long been used in the world of international commercial transactions mainly in the US and Europe and is increasing in importance.
This course aims to focus on international commercial arbitration, which is an extreme application of the Conflict of Laws and International Civil Procedure Law, deepening the students’ knowledge of Conflict of Laws and International Civil Procedure Law by analyzing the legal problems that occur there.

国際私法，国際民事手続法のより専門的な知見を修得させる。
The aim of this course is for students to acquire more specialized knowledge about Conflict of Laws and international codes of civil procedure.
国を異にする二つの企業が国際的な取引を行い，その結果，紛争が発生する。国家の裁判所を利用して紛争を解決する既存の国際民事訴訟のスキームでは，まず，どちらの国の裁判所で当該紛争を解決するかという点に争いが生じてしまい，効率的な紛争の解決がおぼつかないことが少なくはない。それでは，どちらの国の裁判所も用いずに紛争を解決する，いや，そもそも国家の裁判所を用いずに紛争を解決したらどうか。そうした発想から登場したのが「国際商事仲裁」という紛争解決形態であり，欧米を中心とした国際商取引の世界において長らく用いられ，その重要性は，益々高まっている。
この授業では，国際私法，国際民事訴訟法の究極の応用問題ともいえる，国際商事仲裁なる存在に焦点を絞り，そこにおける法的諸問題を分析することによって，国際私法，国際民事訴訟法の知見を深めていくことを目的とする。
