The administrative law assumes the interpretation theory that has been formed historically the element like the field of other law. It is the discipline where it is in this sense at the same period that the administrative law remains in the search studies of historic documents least, and confronts a problem to modify administration to occur in the modern society. In planning cultivation of the underlying ability that is necessary in the study business by considering by the reality concreteness-like expression in the precedent while considering the formation of the interpretation theory about various legal problems in the administrative law by this class; is intended.
We take up the administrative law general remarks and the individual theme in the help and examine the theory situation and a precedent to affect the theme concerned. We learn the background of the modern interpretation theory on this occasion by reading the classic documents carefully. The concrete theme is decided after listening to student requests.

行政法学は他の法分野と同様、歴史的に形成されてきた解釈論をその要素とする。もっとも行政法学は歴史的文献の探求学には留まらず、現代社会に生起する行政に係る問題と対峙する、その意味で同時代的な学問分野でもある。本授業では行政法学における様々な法的課題について、解釈論の形成も視野に入れつつ、判例におけるその現実具体的な発現を検討することにより、研究実務において必要な基礎的能力の涵養を図ることをその目的とする。

行政法総論及び救済法における個別的テーマを取り上げて、当該テーマに係る学説状況や判例を検討していく。その際には古典的文献も精読することにより、現代の解釈論の背景も学んでいく。具体的なテーマは受講生の希望を聴いたうえで決定する。
