The objective of this class is to achieve a specialized understanding of torts, negotiorum gestio (management of business), and unjust Enrichment.
This class will cover torts, negotiorum gestio (management of Business), and unjust enrichment in the “Claims” section of Part III of the Civil Code. While there are not many provisions in the area of torts, it is a field noted for development of law by judicial precedent and theoretical progress due to theories, but it is a field in which one can catch a glimpse of the interesting aspects of “theoretical civil law studies.” Because the lecture time is limited, we will not necessarily be able to touch on every issue, but the schedule is to explain these topics using many cases. When studying this material, please pay attention to the logical flow rather than rote memorization.

The objective of this class is to achieve a specialized understanding of torts, negotiorum gestio (management of business), and unjust Enrichment.
民法典の第三編「債権」のうち，不法行為・事務管理・不当利得に関する部分を扱う。不法行為の領域は，条文数が少ないこともあり，判例による法形成や学説による理論的進展が著しい分野であるが，「理論民法学」の面白さを垣間見ることのできる分野でもある。講義時間が限られているので，必ずしもすべての問題点に触れることはできないが，ケースを多く用いて解説する予定である。学習の際には、暗記に頼らず、論理の流れに注意してほしい。民法概論に比べてアドヴァンストな内容になるので履修の際には注意すること。
