The objective of this course is to achieve a specialized understanding of the systems about the securement of the fulfillment of monetary claims.
This course deals with the basic concepts and principles of Law of Securities (Part Ⅱ, Chapter Ⅶ-Ⅹof the Civil Code) and claims and obligations of multiple-parties, subrogation by performance, and set-offs in the general theory of claims (Part III, Chapter I of the Civil Code).
These rules which are to secure the fulfillment of monetary claims are related to financial transactions which are essential for our everyday life.

この授業では、金銭債権の履行を確保するための方法について、専門的な理解を得ることを目標とします。
The objective of this course is to achieve a specialized understanding of the systems about the securement of the fulfillment of monetary claims.
民法第2編「物権」のうち、いわゆる担保物権法（第2編第7-10章）と、債権総論（第3編第1章）のうち多数当事者の債権債務、弁済による代位、相殺の部分について講義を行います。
これらのルールは、おおむね、金銭債権の履行確保手段に関わる制度です。例えば、銀行が企業に事業資金を貸し付けるとき、銀行は自らの貸金債権の回収を確実なものにするためにどのような手段をとりうるか。このような場面に関わるルールを学びます。そして、これらのルールは、私たちの経済生活で不可欠な金融取引に密接に関連しています。
