This course aims to prepare students who will practice intellectual property (IP) law in the global market by learning about the subject matter of various IP laws, including patent law, industrial design law, copyright law, trademark law, unfair competition prevention law, and geographical indication law, and understanding the differences between Japan, the U.S., and Europe in the protection of these subject matters.
After studying the major international agreements on intellectual property, this course will cover how the obligations under the agreements are implemented in the domestic laws of the European Union (EU) and the United States (US). It will study the legal systems of the intellectual property systems of the EU and the US and compare the subject matter and the scope of protection under patent law, seed law, industrial design law, trademark law, unfair competition prevention law, copyright law, and geographical indication law.

この講義では、特許法、意匠法、著作権法、商標法、不正競争防止法、地理的表示法等の知的財産法の保護対象を学び、これらの保護対象の保護の日米欧の違いを理解することで、学生がグローバル市場における知的財産法法曹実務家となる基礎知識を養う。各知的財産権の対象に保護を与える理由と政策目的を理解し、議論することで論理的思考を育てる。

最初に知的財産に関する主要な条約を学んだあと、条約による義務が欧州連合及びアメリカ合衆国(US)の国内法でどのように履行されているのかについて学ぶ。EUとUSの知財制度の法体系を学んだあと、特許法、種苗法、商標法、意匠法、不正競争防止法、著作権法、地理的表示法の保護対象と権利範囲の基礎概念を日米欧で比較して理解し、これらの権利をどのように組み合わせて製品やサービスをグローバル市場で保護するかについて考える。
