The purpose of this course is to learn about the characteristics and that backgrounds of pre-modern Chinese and the surrounding region's law, to understand that laws vary by age and region, and to consider how the law should be in the present and future.
In China, until the modern laws were established with reference to the European and Japanese modern laws in the late Qing Dynasty, the original legal system (Lü-ling law system) centered on "lü" and "ling" developed from ancient times, it had a significant impact on the laws of Vietnam, Korea, and Japan located around China. In this course, I will give a lecture on the laws of pre-modern China and Vietnam, Korea, Japan. Specifically, I will lecture about establishment and compilation of laws, criminal law, civil law, and judicial proceeding.

この授業の目的は、前近代の中国及びその周辺地域における法律の特徴とその背景を学ぶことを通して、同じ法律でも時代や地域によって違いがあることを理解し、現在さらには未来における法のあり方を考える材料の一つを習得することにある。

中国では清代末期以降にヨーロッパ・日本近代法に基づいて近代的な法律を制定するまで、主に「律」と「令」を中心とする独自の法体系（律令法系）が古くから発達し、中国の周辺に位置するベトナム・朝鮮・日本の法律にも多大な影響を与えてきた。この授業では近代より前の中国及びベトナム・朝鮮・日本などの法律について講義を行う。具体的には、法律の制定と編纂、刑事法、民事法、司法手続などを扱う。

| 6 | 中国刑法史②清代の「比附」について 「比附」とは今日の刑法学でいう「類推適用」にほぼ相当する。本講では清代における比附の事例を概観することを通して、前近代中国刑法の特徴の一つを提示する。 |
| 7 | 中国司法手続史①清代の裁判機構 清代の階層的な裁判機構とその相互関係、特に「必要的覆審制」について概説する。 |
| 8 | 中国司法手続史②清代における裁判手続 訴えの提起・受理、訊問と自白、判決と異議申立てなど、清代における具体的な裁判手続について概説する。 |
| 9 | 中国民法史①田宅の取引と法律 前近代中国における農地・宅地に関する取引と、法律の関係について概説する。 |
| 10 | 中国民法史②親族法と相続法 唐代の場合を例として、前近代中国の親族法（婚姻、離婚、養子縁組など）と相続法について概説する。 |
| 11 | 中国周辺地域の法律①ベトナムの歴史と法律 ベトナムにおける律令受容の過程と、後黎朝『国朝刑律』の具体的内容を、唐律・明律との比較を通して紹介する。 |
| 12 | 中国周辺地域の法律②朝鮮の歴史と法律 朝鮮半島における律令の受容と、法典の編纂について概説する。 |
| 13 | 中国周辺地域の法律③日本の歴史と法律 日本における律令の受容と形骸化の過程・背景を概説する。 |
| 14 | 前近代東洋法の総括と特徴 第13講までの総括を通して、前近代東洋法の特徴を学習する。 |
