The trust is not so familiar in everyday life. But, it is one of the things you would like to understand in order to think about the society in the future.
The course objective is to learn how the trust has evolved and how it is actually used, and understand what the trust is.
In Japan, the trust has been used mainly in the financial area, but it now draws interest and is utilized in other areas as well.
In this course, you will first learn the history of the trust and examples of its actual use to understand the concept of the trust, and then learn the basic mechanism of the trust.

信託は、ふだんの生活ではあまり馴染みがないものです。しかし、これからの社会を考えるにあたって理解しておいたほうがよいものの一つです。
この講義では、信託の歴史や実用例を学んで信託というものを理解することを目標とします。

日本において、信託は、もっぱら金融分野において利用されてきましたが、近年はそれ以外の分野でも着目されまた活用されています。
本講義では、まず信託の歴史やその実用例を学んで信託とはどういうものかをザックリと理解したうえで、その基本的な仕組みを学んでいきます。

信託を際立たせるものとして、信託法に従うと民法とは異なる結論を導き出すことができるということが挙げられます。民法、特に債権法と物権法、についての基礎的な知識があれば、この点がより理解しやすいと思います。
