The objective of this course is to present Japanese criminal procedure as seen by Japanese and international scholars.
This course will present Japanese criminal procedure from a historical and comparative perspective.
The lessons will touch upon on all aspects related to Japanese criminal procedure: its history, its present form, its constitutional dimension, with a particular focus on its current practice.

1 | History of criminal law and procedure before the Meiji period. |
2 | The reception of Western criminal law in the Meiji period. |
3 | Criminal law 1900-1945. The first jury. |
4 | Criminal law reforms after WWII: Constitution and laws. |
5 | Overview of the criminal trial: Basic structure, participants in criminal proceedings. |
6 | Investigation: Beginning of investigation, compulsory and voluntary investigations. |
7 | Investigation: Arrest and detention, search and seizure, interrogation. |
8 | Trial: Overview, lay judge system. |
9 | Evidence: Confession, hearsay. |
10 | Death Penalty: Nagayama Criteria and Hikari parent-child murder incident. |
11 | Prisons in Japan. |
12 | Support for victims. |
13 | Comparative remarks I. |
14 | Comparative remarks II. |
