The objectives of this seminar are to examine the various problems in Civil Law while accurately understanding the positioning of those problems and to become able to derive your own ideas based on legal thinking. At the same time, this seminar aims to enable students to master the techniques which are required for learning and to become a member of society which include researching the literature, preparing as a group for a presentation and giving a report, and engaging in a debate based on a report.
In this seminar, we will focus on the latest issues regarding parent-child law.
Recently, there have been a number of proposals for legal amendments and amendments regarding issues related to parenthood and children. For example, with the Civil Code revision in 2022, the rule of presumption of legitimacy, which forms the basis of the law regarding parentage, was revised. Additionally, the Family Law Subcommittee of the Ministry of Justice's Legislative Council is proposing to introduce joint custody after divorce in January 2024. I would like to consider the norm that should be while considering what problems lie behind these revisions and proposed amendments.
With advances in assisted reproductive technology, the rules of parentage are now being reconsidered. Using court precedents as material, I would like to consider what kind of problems are occurring and what solutions should be taken.
Furthermore, in October 2023, the Grand Bench of the Supreme Court ruled that the gonad removal requirement of the Gender Identity Disorder Special Cases Act is unconstitutional. This is a little off topic from issues related to parents and children, but I would like to consider this as it is an important ruling.
In this seminar, during each session two or three students will present a report on the relevant topic which will form the basis of discussion (each participant will give one reports during the semester). Moreover, the students giving the report will also present the arguments after the report to lead the discussion (the instructor may assist as needed). The instructor wishes to respect the autonomy of all students. Students are required to sufficiently prepare and actively speak up in discussion.
Third and fourth year students can participate in this seminar. I will give as much consideration as possible to job hunting, so please actively participate.

民法に関するさまざまな問題点を検討しながら，問題の正確な位置づけを把握し，法的な思考に基づいて自分の考えを導くことができるようになることを目指します。それとともに，文献を調べる，グループで発表の準備をし報告をする，報告に基づき討論するといった，学問をする上でも社会に出る上でも必要な技術を習得することを目指します。

このゼミでは，親子法をめぐる最新の状況を中心に検討します。
親子に関する問題について，最近法改正や法改正の提案が相次いでいます。たとえば，2022年の民法改正により，嫡出推定という親子に関する法の根幹をなすルールが改正されました。また，法務省法制審議会・家族法制部会では，2024年1月に離婚後の共同親権を導入する提案を行っています。これらの改正・改正提案の背後には，どのような問題があるのかを検討しながら，現代の家族法のあり方を考えてみたいと思っています。
現在では，生殖補助医療の進展により親子関係のルールのあり方も問い直されています。裁判例を素材にして，どのような問題が発生しており，あるべき解決策はどのようなものかも検討したいと思っています。
さらに，2023年10月に，最高裁大法廷は性同一性障害性別取扱特例法の生殖腺摘出要件は違憲であるとの判断を下しました。親子に関する問題とは少し外れますが，重要な判決が出たので検討したいと思っています。
このゼミでは, 毎回2－3名の報告者が該当テーマに関する報告を行い, それに基づいて討論をします (各参加者は, 学期中に1回報告することになります) ｡ また, 報告後の討論の司会をする, つまり論点を提示するのも報告者です (教員が必要に応じて手助けをします) ｡皆さんの自主性を重んじたいと思っています｡ 十分な予習, 積極的な発言が求められます｡
配当年次は3‐4年となっています｡ 就職活動についてもできる限り配慮しますので積極的にご参加ください。
