To cultivate a practical legal interpretation ability through a detailed examination of the latest important judicial precedents
The seminar format will include reports about the latest important judicial precedents by student presenters followed by a discussion among all of the students.
Two lectures will be spent on one judicial precedent with the first session examining the factual relationships, course of litigation, and the relationship between the judgments of each instance, etc., and the second session is scheduled to look at the logical aspects of the decision by focusing on the judicial precedent annotations and scholarly papers.
However, in some cases the examination of a judicial precedent may end after one session.
This seminar welcomes a broad range of students from those with aspirations to become judicial officers and researchers to beginners who heard a lecture on Criminal Law and felt that it was vaguely interesting.

最新重要判例の詳細な検討をとおした実践的な法解釈能力の涵養
To cultivate a practical legal interpretation ability through a detailed examination of the latest important judicial precedents
最新重要判例について、報告者による報告を経たうえ、全員で検討する形式をとります。
ひとつの判例につき講義2回分を費やし、1回目は事実関係や訴訟経過、各審級の判断の関係等を、2回目は判例評釈や学術論文を中心に判決の理論的側面を、それぞれ検討する予定です。
ただし、判例によっては、1回で検討を終了する場合もあります。
法曹・研究者志望者から、刑法の講義を聞いてなんとなく面白いと感じた初学者まで、幅広く歓迎します。
