Students will read key decisions of the U.S. Supreme Court and the Court of Justice of the European Union, as well as articles by leading academics, to understand the theories and policies of intellectual property. Furthermore, we will examine the changes in innovation models and business models brought about by the digital transformation and discuss how these theories can be reformed to achieve policy objectives in light of the changes.
In this seminar, students should identify problems with the current IP systems and write an essay to improve them. A few students are assigned as experts to present assigned cases and articles. All students must read the assigned cases and articles so that they can discuss issues in them. Students develop skills in legal analysis through the discussions and logically explain their analysis and arguments when they answer questions from the instructors and classmates.

アメリカ最高裁や欧州連合司法裁判所の主要判決や研究者による論説を読み、知的財産保護の理論や政策を理解する。更に、デジタルトランスフォーメンションによってもたらされたイノベーションモデルやビジネスモデルの変化を考慮し、政策目的達成のためのこれらの理論の在り方について議論する。

このクラスは現在の知的財産制度の問題点を見つけ、改善策について小論文を書き、自分の分析をプレゼンするセミナーである。毎回、数人の学生が事前に担当者として選ばれ、判決や論文の内容を発表する。担当者以外の学生も判決・論文を読んできて、論点について議論できるように準備してくる。議論を通し、法律的分析の手法を学ぶ。興味のある論点について分析し改善策をプレゼンし、講師やクラスメートの質問に答えることで、自分の分析や主張を論理的に説明する能力を身につける。
