to (re-) learn Civil Code focusing on its use in litigation cases; to (re-)learn how Civil Procedure works as where specific disputes resolved in accordance with Civil Code.
Civil disputes are resolved through litigations regulated by Code of Civil Procedure, in accordance with Civil Code. It likely suggests students should study these two as an unified package, though, the fact in most undergraduate programs is they are taught as independent subjects or classes, none of which tells you how their interplay in real litigations be like. This seminar, picking up so-called ''YOKEN-JIJITSU-RON'' as materials, which you must learn before becoming a Japanese professional lawyer, offers you an opportunity to have a rough picture of the mutual relationship of the two areas of law in a real dispute resolution process, as well as to learn each area of law more deeply and in more practical sense.

民事訴訟における利用のされ方に即した形で民法を（再）学習し、民法の適用による具体的な紛争解決を行う場としての民事訴訟（法）のあり方を（再）学習すること。

私人間の紛争は、民事訴訟法により規律される民事訴訟を通じて、民法の定めに従って解決される。したがって、民法と民事訴訟法はセットで理解されて然るべきものであるが、学部のカリキュラム上、両者は別々の科目となっており、また、それぞれの科目を受講したとしても、両者がどのように協働ないし交錯しているのかを体感することは難しい。本演習では、法曹となる過程で触れることになるいわゆる「要件事実論」における議論を素材として、学部生のうちに、現実の紛争解決過程で民法と民事訴訟法がどのように交わるのかについてのイメージをつかむ機会を提供するとともに、民法・民事訴訟法のより深くかつ実用的な理解につなげたい。
演習の具体的な進め方は、参加人数・レベル・希望に応じて柔軟に調整したい。

本演習で扱う「要件事実論」をこなすには、民法と民事訴訟法の知識（少なくとも学習意欲）が欠かせない。演習開始前の学習経験について必須の要求をするものではないが、教材等に登場する民法・民事訴訟法上の諸制度・概念について授業内で逐一解説する余裕はないので、学習経験が不足している者が参加する場合は、自習によってキャッチ・アップをしてもらう必要がある。

＜選考方法＞
採用人数：10名程度
配当年次：３・４年
選考方法：下記の課題によるが、応募者多数の場合のみ成績を加味して選抜する。
①題目：ゼミの志望理由と自己紹介（民法・民事訴訟法をどこでどれだけ勉強しているかを含む）。法曹志望者であるかは差し支えなければ記載してもらいたいが、法曹志望者以外の参加はもちろん歓迎である。
②字数：特に指定しない。
