To understand the normative meaning of the provisions of the Constitution of Japan and the foundation of modern constitutionalism on which the Constitution was established.
In this course, students will learn about the Constitution of Japan while referring to their historical background, intentions of the drafters, judicial precedents, and other materials as well as comparisons with foreign countries.

日本国憲法およびその背景にある近代立憲主義という考え方につき理解する。
To understand the normative meaning of the provisions of the Constitution of Japan and the foundation of modern constitutionalism on which the Constitution was established.
日本国憲法につき、その歴史的背景、起草者意図、判例等を参照したり、諸外国との比較にも目配りしつつ、概論的講義を行う。

憲法は、それぞれの国の基本ソフトであるから、その国の社会に生起する出来事それ自体が最重要の考察対象となる。したがって、本科目で勉強したことと関連付けながら新聞記事やニュースを見たり、授業と並行して関連文献を読んだりすると、学習効果が一層高まるであろう。
