【Course Objectives】

Learn about the legal structure of the Local Autonomy Act. The goal is to (1) learn about the organization of local government, which is the government closest to you. (2) Recognize the actual situation of the relationship between the national government and local governments, which are supposed to be equal and equal, and (3) Recognize the situation occurring in the field of local self-government and consider the future direction.

【Course Contents】

The Local Autonomy Law came into effect at the same time as the Constitution of Japan on April 17, 1947 , in order to embody the local autonomy guaranteed by Chapter 8 of the Constitution of Japan. In other words, the Local Autonomy Law is a law that can be called a constitutional implementation law (or a supplementary law to the Constitution) enacted based on the explicit delegation of the Constitution, and it can be said that it is a law for realizing the ideals of the Constitution in the region.
Therefore, local governments are considered bastions of human rights protection, realizing the well-being of their residents.
For example, with regard to the rights of sexual minorities, local governments are taking the lead in protecting their human rights.
With regard to the rights of resident foreigners, some municipalities have established foreign citizen representative councils while foreign residents are not given the right to vote. In this way, local governments have always been ahead of the national government in developing policies such as pollution prevention ordinances and environmental assessments to protect the health of residents, as well as information disclosure and administrative procedure ordinances aimed at open administration.
However, the local government is now in a state of disrepair. The number of local government employees who struggle day and night for the happiness of their residents while struggling with tight finances is the smallest in OECD countries.
In this lecture, students will learn about the legal structure of the Local Autonomy Act, which has supported the advanced efforts of local governments, and consider the gap between the philosophy and the actual situation in the field of local government.
