It aims at acquiring basic understandings of empirical legal research and the perspectives to analyze legal issues. Also, it aims at learning how to make a rough design on empirical legal research.
This course requires students to read essential research articles which explore legal phenomena empirically. Those articles are written in English. Students are required to make a summary of each article and to identify the points to be questioned or to be discussed. Based on that report, we will have a discussion. The list of articles to be read will be shown on the first day of the course, although there is room to modify the list depending on the interests of students. Lastly, students are required to present a rough research design.

法社会学に関する基礎的な研究について大まかな知識を獲得するとともに，実証的な観点から法的問題を考える視点を獲得する。さらに，そのような実証的な研究を大まかにでも構想する能力の獲得を目指す。
It aims at acquiring basic understandings of empirical legal research and the perspectives to analyze legal issues. Also, it aims at learning how to make a rough design on empirical legal research.
法現象を解明することを試みた実証研究のうち特に重要なものを取り上げて講読する。講読の対象となる論文は，主として英語で発表されたものを用いる．対象論文について要約し，疑問点や議論すべきポイントをまとめたレジュメを学生に用意してもらい，それに基づく討論を行う。講読する文献は，初回にリストとして提示するが，学生の関心に即して必要に応じて調整する。また，それらの論文を参考にしながら，大まかな研究計画を構想してもらう。

事前に文献を読み，その概要，疑問点，議論すべきと考える点をまとめてくる。疑問点や議論すべき点をまとめるにあたっては、指定された文献だけではなく、それと関連する必要と思われる文献についても収集し、それらについても読み込んでくることが求められる。また，それらの研究を参考にしながら，自分の関心のある問題についてどのような研究が可能かを考えてもらい、その内容を最終回に報告してもらう。したがって、文献講読と並行して、自身の関心のある問題に関連する文献や、調査方法に関する文献を読み進めることが求められる（調査方法に関する文献については、適宜履修者の問題関心を踏まえながら候補を提示する）。
